PURPOSE:

The Department is initiating rulemaking in accordance with Section 5 of Chapter 2020-150, Laws of Florida, to update the stormwater design and operation regulations adopted under Section 373.4131, Fla. Stat., including updates to the Environmental Resource Permit Applicant’s Handbook Volume I, using the most recent scientific information available.  Furthermore, the Applicant’s Handbook Volume II within the Northwest Florida Water Management District will be updated under this rulemaking, and any updates to Applicant’s Handbook Volume II made by the other water management districts will also be incorporated by reference.

SUBJECT:

The Department and Water Management Districts will be developing amendments to update the stormwater design and operation regulations; and will consider and address low-impact design best management practices and design criteria that increase the removal of nutrients from stormwater discharges, and measures for consistent application of the net improvement performance standard to ensure significant reductions of any pollutant loadings to a waterbody.  The rulemaking pursuant to this notice is expected to include amendments to update Chapter 62-330, Fla. Admin. Code, the Applicant’s Handbook Volume I that applies statewide, and the Applicant’s Handbook Volume II that applies within the Northwest Florida Water Management District.  A separate Notice of Development of Rulemaking will be published by each of the other four regional water management districts to initiate rulemaking for each of the remaining Applicant’s Handbook Volume II as part of this coordinated rulemaking effort.
