NOTICE IS HEREBY GIVEN that on March 16, 2009, the Department of Health, received a petition for Emergency Variance from subsection 64E-11.008(2), Florida Administrative Code. This rule states, “Studs, joists and rafters shall not be left exposed in walk-in refrigeration units, in food preparation or washing areas or toilet rooms.” The petitioner, Brian Cross and Brandon Hoffman, Fuhgetaboutit, Inc., 7004 Cortez Road, West, Bradenton, FL 34210, seeks to have an exposed ceiling in the food (beverage) preparation area.
