Notice of Declaratory Statement

NOTICE IS HEREBY GIVEN that the Department of Business and Professional Regulation, State of Florida has received the petition for declaratory statement from Club Madonna, Docket Number DS 2011-015. The petition seeks the agency's opinion as to the applicability of Section 561.01, Florida Statutes, as it applies to the petitioner.
The Petitioner requests a declaratory statement inquiring whether an entertainment club may permit its patrons to supply and consume their own alcoholic beverages on premises without the club obtaining an alcoholic beverage license. The entertainment club would not offer storage for the alcoholic beverages or any supplies for the consumption of the alcoholic beverages; except for non-alcoholic drinks already sold on the premises. The patrons would bring their own alcoholic beverages into the club and maintain custody of the beverages while on the premises. No payment would be made to the entertainment club for consumption of alcohol on premises by its patrons. Petitioner inquires whether such a practice without an alcoholic beverage license would be in violation of the Florida Beverage Laws, Chs. 561-565, F.S.
