NOTICE IS HEREBY GIVEN THAT the Department of Financial Services, Division of State Fire Marshal has declined to rule on the petition for declaratory statement filed by Miami-Dade County Fire Rescue Department, Chief Manny C. The Department denied the Petition for Declaratory Statement because while having the authority to interpret the relevant statutes, the Department can only interpret statutes in a declaratory statement when provided with a specific fact scenario. Florida Optometric Ass’n v. Department of Professional Regulation, Board of Opticianry, 567 So.2d 928, (Fla. lst DCA, 1990).
