NOTICE IS HEREBY GIVEN THAT the Florida Building Commission has issued an order disposing of the petition for declaratory statement filed by Kenneth Gregory of Holland Pools, DCA09-DEC-419, joined by Robert Deatherage, Osceola County Building Official on December 25, 2009. The following is a summary of the agency's disposition of the petition:
The Commission determined that Section 1004.1.1, Florida Building Code (FBC), Building Volume, applies to an outdoor public swimming pool with a cabana and deck, for the purpose of determining means of egress requirements, and that the plumbing fixture count for the pool and deck area must be in accordance with Section 403.8, FBC, Plumbing Volume, and the total plumbing fixture count must include the total fixture count required for the pool added to the total fixture count required for the cabana bath.
