RULE NO: RULE TITLE
40B-2.301: Conditions for Issuance of Permits
PURPOSE AND EFFECT: The purpose of the rule development is to update this section of Chapter 40B-2, Florida Administrative Code, to add permit duration criteria for permits issued in the Upper Santa Fe River basin. The effect of the rule development will set forth factors for duration that provide reasonable assurance that the proposed water use satisfies the criteria for a 20-year permit duration. If reasonable assurance cannot be provided for a 20-year permit duration, permits may be issued for shorter durations which reflect the period for which reasonable assurances can be provided.
SUBJECT AREA TO BE ADDRESSED: This proposed rule development will set forth permit duration criteria for permits issued in the Upper Santa Fe River basin, based on reasonable assurance that the proposed water use satisfies criteria for the specific duration.
