NOTICE IS HEREBY GIVEN THAT the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has declined to rule on the petition for declaratory statement filed by David Haber on behalf of Portofino/South Pointe Master Association, Inc., Docket Number 2009019992, on April 16, 2009. The following is a summary of the agency's declination of the petition:
The division declined to issue a declaratory statement because the division cannot issue a declaratory statement concerning events that have already taken place; or where there are facts in dispute; or where there are owners who will be affected by the decision and who are not parties to the petition.
