NOTICE IS HEREBY GIVEN THAT Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida has received the petition for declaratory statement from Gary Ziomek, Petitioner, In Re: The Jupiter Beachcomber Condominium Association, Inc., Docket No. 2009031500.The petition seeks the agency's opinion as to the applicability of Section 718.112(2)(d)1., Florida Statutes (2008) as it applies to the petitioner.
Whether a unit owner, who was convicted of a felony and whose civil rights were restored in March 2007, is eligible to be a candidate for election to the Jupiter Beachcomber Condominium Association, Inc. board of directors in 2009 under Section 718.112(2)(d)1., Florida Statutes (2008).
