23-23.006: Conditional Release Definitions
NOTICE IS HEREBY GIVEN THAT the Florida Parole Commission has issued an Order Denying Petition to Initiate Rulemaking in response to a Petition filed by Steven R. Baer, on May 14, 2008. By order dated July 2, 2008, the Commission denied the Petition finding any proposed changes to subsection 23-23.006(11), F.A.C., to revert back to the rule prior to the changes in 2002 would be out of conformity with Section 947.1405(2)(a), Florida Statutes, and would result in further confusion which the 2002 changes resolved. Furthermore, the prior subsection 23-23.006(11), F.A.C., was changed since it impermissibly imposed a sequential obligation that the legislature did not intend, thereby unlawfully enlarging the statute by rule.
