NOTICE IS HEREBY GIVEN that on April 04, 2008, the Department of Health has issued an order.
disposing of a Petition for Waiver from the permitting requirements of Rule 64E-15.010, F.A.C., as filed by Cedar Key United Methodist Church. The petition was filed with the Department on February 22, 2008 and noticed in the Florida Administrative Weekly, on March 7, 2008, in Vol. 34, No. 10.
The Department determined that Petitioner was unable to meet the requirements for the Petition for Waiver because the requirement to obtain a permit from the department is established in Sections 513.02 and 120.542(1), F.S., prohibits a state agency from varying statutory requirements. Therefore, the petition for a permanent waiver is DENIED.
