NOTICE IS HEREBY GIVEN THAT The Board of Architecture and Interior Design hereby gives notice that it has issued an order disposing of the petition for declaratory statement filed by John T. Sefton, Esquire, on behalf of Barley Consulting Group, LLP. on February 03, 2006. The following is a summary of the agency's disposition of the petition:
The Notice of Petition for Declaratory Statement was published in Volume 32, No. 7, of the February 17, 2006, Florida Administrative Weekly. Petitioner sought the Board’s interpretation of Section 481.219, Florida Statutes, entitled “Certification of partnerships, limited liability companies, and corporations,” and whether Barley Consulting Group, LLP, would be required to obtain a certificate of authorization to perform building inspection services as described in Section 468.603(8), Florida Statutes, through a business managed by a Florida licensed architect. The Board of Architecture and Interior Design considered the Petition at its meeting held on February 23, 2006, in Fernadina Beach, Florida. The Board’s Order, filed on April 6, 2006, answered the Petition for Declaratory Statement in the affirmative, finding that the provision of building inspection services, as described in Section 468.603(8), Florida Statutes, through a business managed by a Florida licensed architect, does constitute the practice of architecture, as defined in Section 481.203(6), Florida Statutes, and the business would be required to obtain a certificate of authorization under Section 481.219, Florida Statutes.
