NOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has received the petition for declaratory statement from Michele L. A. Rollins, Esq., David Grigaltchik, Esq., and Dale Dixon, Esq., on behalf of a group of Unit Owners of the Oak Park Villa Condominium Association of Jacksonville, Inc., on September 27, 2012, Docket No. 2012040894.The petition seeks the agency's opinion as to the applicability of section 718.116(11), Florida Statutes, as it applies to the petitioner.
Whether Oak Park Villa Condominium Association may break into a unit, change the locks and rent the unit to outside parties without a delinquent unit owner’s consent under section 718.116(11), Florida Statutes.
