PURPOSE:

The Department of Environmental Protection is revising Chapter 62-610, F.A.C., to correct regulatory references and clarify current language which will ensure proper regulation for the use of reclaimed water in the state of Florida. The proposed revisions add clarity to both substantive and administrative aspects of the chapter.

SUMMARY:

Proposed revisions to Chapter 62-610, F.A.C., correct regulatory references and clarify current language consistent with other title 62 chapters. Revisions include updating DEP Form 62-610.300(2)(a)2 “Annual Reuse Report” to require electronic submittal of the form through the Department’s online business portal. Revisions to DEP Form 62-610.300(2)(a)4, “Pathogen Monitoring” requires the electronic submittal of the form and eliminates the requirement for permittees to submit paper copies to multiple Department programs/offices. Two separate rulemaking efforts will be undertaken by the Department in order to amend the chapter. Phase I addresses   revisions as outlined above. Phase II will address revisions to 62-610, F.A.C.,  Chapter 62-600, F.A.C. and Chapter 625, F.A.C. necessary to adopt recommendations of the Potable   Reuse Commission’s 2020 report “Advancing Potable Reuse in Florida: Framework for the Implementation of Potable Reuse in     Florida” as required by Florida’s Clean Waterways Act of 2020.
