Use of Epinephrine Auto-Injectors and Anaphylaxis Policy

PURPOSE:

During the 2026 Legislative Session, sections 1002.20 and 1002.42, Florida Statutes, were amended with House Bill 1279, Education. Section 1002.20, F.S., allows additional flexibility for students in public schools who have experienced, or are at risk for, life-threatening allergic reactions by authorizing them to carry and self-administer epinephrine through any United States Food and Drug Administration-approved epinephrine delivery device, instead of only auto-injectors. The proposed rule amendments will align the language to reflect the change in statute.

SUMMARY:

The proposed rule amendments will align the regulation of epinephrine delivery devices for students.
